A South Korean vlogger has ignited controversy by claiming she terminated her pregnancy at nine months. The woman’s identity remains undisclosed, and she is now under investigation for murder, causing widespread shock throughout the nation. This incident has highlighted gaps in South Korea’s abortion laws, which currently lack clear regulations on when, where, or how abortions can be conducted.

The claims made by the vlogger have drawn intense public scrutiny and outrage, raising urgent questions about the existing legal framework surrounding abortion in South Korea. As the investigation unfolds, many are left to grapple with the implications of this case on societal norms and legal standards regarding reproductive rights.

The Seoul National Police initiated an investigation into the vlogger in July, prompted by a request from the South Korean government after she uploaded a YouTube video claiming to document her abortion experience. 

Historically, South Korea had stringent regulations regarding abortion, treating it as a criminal offense punishable by up to two years in prison. Exceptions were only permitted in cases of rape, incest, or when the mother’s life or health was at risk. However, for the past four years, there has been a policy vacuum regarding this issue following a landmark ruling by the Constitutional Court.

In 2019, the Constitutional Court overturned the existing ban on abortion, instructing the National Assembly to enact new legislation by the end of 2020. The court recommended a limit of 22 weeks for legal abortions, but the legislature failed to comply with this deadline. As a result, the previous criminal provisions expired, effectively legalizing abortion at any stage of pregnancy in South Korea.

In June, the Ministry of Justice stated that discussions about revising the abortion laws are ongoing. The ministry noted the need for consultations with the Health and Welfare Ministry, which oversees maternal and child health regulations. It emphasized the importance of balancing the rights of the fetus with the health and autonomy of pregnant women in any future legal framework.

Despite the absence of a formal ban on abortion, the lack of clear regulations has created ambiguity regarding permissible practices. As reported by CNN, obtaining reliable information on where and how to access abortion services remains challenging in South Korea. This uncertainty has left many women without adequate guidance and support during their reproductive choices.

The current situation highlights the urgent need for legislative action to establish comprehensive abortion laws that provide clarity and protect women’s rights. Advocates argue that without proper regulations, vulnerable individuals may be at risk of unsafe procedures, emphasizing the importance of developing a legal framework that addresses both health and ethical considerations surrounding abortion.
